General Policy and Rules

Yellowmarket policies and rules are the common guidelines that create a safe, trusted and fair digital trading environment for all user. To promote a business with safe and trusted digital trading environment at Yellowmarket.

User agreement All members are responsible for reviewing and understanding Yellowmarket policies and local judiciary laws and regulations contained in this legal contract.

Rules for Everyone. General policies applying to all Yellowmarket user and Yellowmarket employees. This section includes rules that protect your privacy and your identity. Learn more about issues like the use of profanity, unsolicited email (spam) etc.

Prohibited and Restricted Items. There are many items that are restricted to sell online at Yellowmarket, such as liquor, adult content/material, banned items such as weed and ivory ? Find out in our comprehensive list of banned and restricted items.

Keyword Spamming Policy. This policy is designed to restrict sellers not to abuse brand names as keywords in product listings to drive attention

Links Policy. This policy is designed to restrict sellers to inappropriately add links in its product listings or online storefront to move traffic away from Yellowmarket.

Rules about Copyright. Yellowmarket take instant action towards copyright violations. Please notify yellomarket in case any violation has occurred. Best of our knowledge we will take appropriate action as soon as possible.

Prohibited and Restricted Items

Following items are not allowed to be sold/displayed online at Yellowmarket. Please note that merchants/sellers are responsible for any legal issues and other liabilities arising if you try and sell these below mentioned items at Yellowmarket.in . We will cancel the listing of prohibited and restricted items within 24 hours after we come to know about such occurrence.

  • Adult Material which includes pornography and other sexually suggestive materials (including literature, imagery and other media); escort or prostitution services
  • Alcohol including alcoholic beverages such as beer, liquor, wine or champagne)
  • Animals and Wildlife Products - examples include live animals, mounted specimens, and ivory
  • Artefacts prohibited for sale
  • Beta Software
  • Bootleg/Pirated Recordings
  • Brand Name Misuse
  • Bulk marketing tools which include email lists, software, or other products enabling unsolicited email messages (spam)
  • Cable descramblers and black boxes which includes devices intended to obtain cable and satellite signals for free
  • Catalogue and URL Sales
  • Child pornography which includes pornographic materials involving minors
  • Copies of unauthorized Copyrighted materials whether in electronic or physical form or any other medium which may not be in existence at present
  • Counterfeit Currency and Stamps
  • Drugs and drug paraphernalia which includes illegal drugs and drug accessories, including herbal drugs like salvia and magic mushrooms
  • Drug test circumvention aids which includes drug cleansing shakes, urine test additives, and related items
  • Embargoed Goods and Prohibited Countries
  • Endangered species which includes plants, animals or other organisms (including product derivatives) in danger of extinction

  • Miracle cures which includes unsubstantiated cures, remedies or other items marketed as quick health fixes

  • Copyright unlocking items that includes Mod Chips or other devices designed to circumvent copyright protection
  • Movie Prints
  • Offensive Material - examples include ethnically or racially offensive material or any literature, products or other materials that: a) Defame or slander any person or groups of people based on race, ethnicity, national origin, religion, sex, or other factors b) Encourage or incite violent acts c) Promote intolerance or hatred
  • Offensive goods, crime which includes crime scene photos or items, such as personal belongings, associated with criminals
  • Police, Army, Navy and Air force Related Items
  • Pre-Sale Listings
  • Prescription drugs or herbal drugs or any kind of online pharmacies which includes drugs or other products requiring a prescription by a licensed medical practitioner
  • Promotional Item
  • Real Estate
  • Regulated goods which includes air bags; batteries containing mercury; Freon or similar substances/refrigerants, chemical/industrial solvents, government uniforms, car titles or logos, license plates, police badges and law enforcement equipment, lock-picking devices, pesticides; postage meters, recalled items, slot machines; goods regulated by government or other agency specifications
  • Replica and Counterfeit Items including imitations of designer goods; items without a celebrity endorsement that would normally require such an association, fake autographs, counterfeit stamps, and other potentially unauthorized goods
  • Ringtones
  • Stocks and Other Securities or related financial products
  • Stolen Property
  • Surveillance Equipment
  • Tobacco and cigarettes includes cigarettes, cigars, chewing tobacco, and related products
  • Traffic devices which includes radar detectors/ jammers, license plate covers, traffic signal changers, and related products
  • Weapons which includes firearms, ammunition, knives, brass knuckles, gun parts, and other armaments
  • Wholesale currency which includes discounted currencies or currency exchanges
  • Work-at-home information
  • Matrix sites or sites using a matrix scheme approach
  • Any kind of services not related to products
  • Any other product or service which is not in compliance with all the applicable laws and regulations whether federal, state, local or international including the laws of India
YELLOWMARKET RESERVES THE RIGHT TO MODIFY, UPDATE AND ALTER THE LIST FROM TIME TO TIME WITHOUT ANY PRIOR INTIMATION. TO MAKE SURE YOU ARE AWARE OF ANY CHANGES, PLEASE REVIEW THE LIST PERIODICALLY.

Keyword Spamming Policy

Keyword spamming occurs when sellers place brand names or other inappropriate keywords in a title or description for the purpose of gaining attention or diverting members to a listing. Keyword spamming in listings is not permitted on Yellowmarket. The text sellers place in listings must be directly relevant to the item being sold.

Violations of this policy may result in a range of actions, including:

  • Product Listing cancellation
  • Limits on account privileges
  • Account suspension
  • Loss of Top Rated Merchant status at Yellowmarket.in

Links Policy

In general, when listing items on Yellowmarket.in, sellers can include links that are solely intended to provide additional details about the items. That means links should only be used in circumstances when that information can't be included in the listing itself. These links include additional images, technical specifications, manufacturer warranties, and other information that can help buyers make an informed purchasing decision. Other links that point to a third-party provider's Website are also allowed, such as image hosting sites, payment processors or courier companies.

Yellowmarket doesn't allow links to non-Yellowmarket sites or content where other items are offered for sale. Yellowmarket carry regular reviews on links of the site and reserves the right to block any link which are considered unsafe for the users. As a merchant, please make sure that your listing follows links policy of Yellowmarket. If it doesn't, it may be removed, and you may be subject to a range of other actions, including limits your selling privileges and/or suspension of your account.

Company reserves the right:

  • Vendor agrees and acknowledges that the Company, at all times during the continuance of this Agreement, shall have the right to remove/block/delete any text, graphic, image(s) uploaded on the online store by the Vendor without any prior intimation to Vendor in the event the said text, image, graphic is found to be in violation of law, breach of any of the terms of this Agreement, terms and conditions of Yellow-market Website. In such an event, the Company reserve the right to forthwith remove/close the online store of the Vendor without any prior intimation or liability to the Vendor.
  • Company reserves the right to provide and display appropriate disclaimers and terms of use on Yellow-market portal.
  • At any time if the Company believes that the services are being utilized by the Vendor or its Customer in contravention of the terms and provisions of this Agreement, Terms and conditions of use of Yellow-market Shopping, the Company shall have the right either at its sole discretion or upon the receipt of a request from the legal / statutory authorities or a court order to discontinue/terminate the said service(s) to Customer or the End user as the case may be, without liability to refund the amount to the Vendor to forthwith remove/block/close the online store of the Vendor and furnish such details about the Vendor and/or its customers upon a request received from the Legal/ Statutory Authorities or under a Court order

Company Not Liable

  • The Company on the basis of representation by the Vendor has created the online store of the Vendor on Yellow-market Shopping portal to enable Vendor to offer the Vendor’s products for sale through the Online Store. This representation is the essence of the Contract.
  • The Company shall under no circumstances be liable or responsible for any loss, injury or damage to the Vendor, or any other party whomsoever, arising on account of any transaction under this Agreement or as a result of the Products being in any way damaged, defective, in unfit condition, infringing/ violating any laws / regulations /intellectual property rights of any third party. Vendor agrees and acknowledges that
  • Vendor shall be solely liable for any claims, damages, allegation arising out of the Products offered for sale through its online store (including but not limited to quality, quantity, price, merchantability, use for a particular purpose, or any other related claim) and shall hold the Company harmless and indemnified against all such claims and damages.
  • Further the Company shall not be liable for any claims, damages arising out of any negligence, misconduct or misrepresentation by the Vendor or any of its representatives
  • The Vendor hereby agrees, confirms and acknowledges that the Product is owned by the Vendor and that the Company is merely a facilitator for sale of the Vendor’s Product, hence the Company is not responsible/ liable for the Product, its design, its function and condition manufacturing and selling and financial obligations, warranties, guarantees whatsoever. The Company reserves its right to state appropriate Disclaimers on its website/ online store.

Obligations of the Vendor

The Vendor shall:

  • Through the interface provided by the Company on the creation on Online Store of Vendor, shall upload the product description, images, disclaimer, delivery time lines, price and such other details for the products to be displayed and offered for sale through the said online store.
  • Vendor shall ensure not to upload any description/image/text/graphic that is unlawful, illegal, objectionable, obscene, vulgar, opposed to public policy, prohibited or is in violation of intellectual property rights including but not limited to Trademark and copyright of any third party. Vendor shall ensure to upload the product description and image only for the product which is offered for sale through the Online Store and for which the said Online Store is created.
  • Vendor shall provide full, correct, accurate and true description of the product so as to enable the customers to make an informed decision.
  • Vendor shall be solely responsible for the quality, quantity, merchantability, guarantee, warranties in respect of the products offered for sale through their online store
  • At all times have access to the Internet and its email account to check the status of approved orders.
  • In the event the products are not accepted by the Customer due to any wrong / damaged products dispatched, then the same shall be replaced by the Vendor at no extra cost to the aggrieved customer. Since the Company is a Facilitator, the Vendor hereby authorizes the Company to entertain all claims of return of the Product in the mutual interest of the Vendor as well as the Customer
  • The Vendor shall not send any of its promotional or any other information with the Products ordered by the customer and also shall ensure that no material or literature is sent which may be detrimental to the business/commercial interests of the Company,
  • The Vendor shall dispatch the Products of same description, quality and quantity and price as are described and displayed on the Online Store and for which the Customer has placed the order.
  • Vendor shall raise invoice in the name of Customer. Vendor further undertakes and agrees to raise the invoice of an amount equivalent to the amount displayed on the online store to the customer and paid by/charged to the customer.
  • The Vendor shall not offer any Products for Sale on the Online Store, which are prohibited for sale, dangerous, against the public policy, banned, unlawful, illegal or prohibited under the Indian laws.
  • The Vendor shall ensure that they own all the legal rights in the Products that are offered for sale on the Online Store
  • The Vendor shall pass on the legal title, rights and ownership in the Products sold to the Customer.
  • Vendor shall be solely responsible for any dispute that may be raised by the customer relating to the goods, merchandise and services provided by the Vendor.
  • The Vendor shall at all time during the pendency of this agreement endeavour to protect and promote the interests of the Company and ensure that third parties rights including intellectual property rights are not infringed.
  • The Vendor shall at all times be responsible for compliance of all applicable laws and regulations including but not limited to Intellectual Property Rights, Local Sales Tax, Central Sales Tax, Service tax, Value added tax, Standards of Weights & Measures legislation, Sale of Goods Act, Excise and Import duties, Drugs and Cosmetics Act, Drugs and Remedial Magic Act, Code of Advertising Ethics, etc.

Rules about Intellectual Property

Yellow-market is committed to protecting the intellectual property rights of third parties and to providing a safe marketplace to trade. Unauthorized use or Infringement of copyright material and trademarks are strictly prohibited at Yellow-market.

Yellow-market has zero tolerance for any intellectual property violations. Counterfeits, unauthorized replicas, unauthorized items (such as counterfeit watches, handbags, or other accessories) or unauthorized copies (such as copies of software programs, video games, music albums, movies, television programs, or photographs) are not permitted at Yellow-market. Unauthorized copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged. It is illegal to sell unauthorized copies of media. If the product you are selling bears the name or logo of a company, but it wasn't made or endorsed by that company, don't list it at Yellow-market.

Academic software is software sold at significantly discounted prices to students, faculty members and educational institutions. Do not list academic copies of software At yellow-market unless you are authorized to do so as an educational reseller, an educational institution a student or a faculty member.

Beta software, test software and evaluation software are not permitted at Yellow-market. Beta, test, and evaluation copies of software are preliminary copies of software distributed by software developers strictly for the purpose of evaluation and troubleshooting.

Do not list "OEM" or "bundled" copies of software At Yellow-market unless you are selling it with computer hardware. For Context, Original Equipment Manufacturer (OEM), or bundled software, is software that is obtained as part of the purchase of a new computer. OEM software licenses usually prohibit the purchaser from reselling the software without the computer or, in some cases, without any computer hardware.

Violations of this policy may result in a range of actions, including:

Pricing Policy

Please note that trust is the most important aspect of trade between buyers and sellers in marketplace and one of the key aspects of trust is fair pricing. For healthy transaction flow at Yellowmarket.in , we ask you to price your items responsibly.

Please note that we are constantly monitoring prices for each seller at various channels and do not allow you to price your items at higher prices at Yellow-market v/s other channels such as your own retail store, your own Website (if any) or any other 3rd party retail stores or Websites. You should price your items sold at Yellow-market to be same as the lowest rate you are selling at elsewhere or even lower but it should not be more. Violation of our pricing policy will result into warning notices and can also result into account suspension and/or store suspension.

MRP Policy

Please note the trust you build with your buyers will go away if you artificially start showing higher MRP, so that the selling price appears to be much better deal vs. what it actually is. Artificially increasing MRP is strictly prohibited at Yellow-market and any violation will result into account suspension

Vendors Query

Do I need to courier my products to Yellow Market?

No, Yellow Market will handle shipping of your products. All you need to do is pack the product and keep it ready for dispatch. Our logistics team will pick up the product from you and deliver it to the customer.

How do I sell on Yellow Market?

To sell on Yellow Market:

  • Register yourself at yellowmarket.in
  • List your products under specific product categories.
  • Once an order is received, pack the product and mark it as ‘Ready to Dispatch’. Our logistics team will pick up the product and deliver it to the customer.
  • Once an order is successfully dispatched, Yellow Market will settle your payment within 7-15 business days based on your seller tier.

Required document

  • PAN Card(Personal PAN for business type “Proprietorship” and Personal + Business PAN for business type as “Company”)
  • Bank account and supporting KYC documents ( Address Proof, and Cancelled Cheque)

Who decides the price of the products?

As a seller, you will set the price of your products

Who takes care of the delivery of my products?

Our Yellow-market team will pick up the product from you and deliver it to the customer. All you need to do is keep it packed and ready for dispatch.

How and when will I get paid?

The payment will be made directly to your bank account through NEFT transactions. Yellow-market will settle your payments within 7-15 business days based on your seller tier.

When can I start selling?

After all the required documents have been verified and your seller profile is complete, you can start listing your products and start selling.

How many listings are required to start selling?

You are required to have a minimum of 4 listings(unique products) to start selling on Yellow-market .

Customer Communication Policy

Sellers at Yellow-market are prohibited to engage in direct communication with buyers for any pre-sale, order, payments, shipping, Post sale or returns related matters. Merchants are also not allowed to engage in direct or indirect marketing communication with buyers at Yellow-market. For specific product inquiries, warranties, shipping/delivery etc., Yellow-market can intermediate the communication between buyer and sellers. However, sellers should not be engaged in communication with the buyers. Violations of policy may result in a range of actions including:

  • Limits on account privileges
  • Account suspension
  • Loss of Top Rated Merchant status at Yellowmarket.in
